EVARA TERMS OF USE

Welcome to EVARA, an art-led gifting platform created to bring original art, thoughtful products and meaningful impact together.

By accessing or using the EVARA website, placing an order, creating an account or using any of our services, you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the website.

1. ABOUT EVARA

EVARA is a platform that showcases and sells thoughtfully designed products featuring original artworks created by independent artists and SHILPKAAR artists. Our products may be created, manufactured, packaged and fulfilled by EVARA, its partners, artisans, artists or third-party service providers. EVARA may update, modify or discontinue products, collections, services or website features at any time.

2. ELIGIBILITY

You must be legally capable of entering into a binding contract under applicable Indian law to place an order on EVARA. If you are purchasing on behalf of an organisation, you confirm that you have the authority to do so.

3. PRODUCTS & REPRESENTATION

We make every reasonable effort to ensure that product descriptions, images, colours, dimensions and specifications displayed on the website are accurate. However, because many EVARA products feature artwork and handcrafted or digitally reproduced elements:

• Colours may vary slightly between screens and the physical product. 
• Minor variations may occur in texture, printing and finish. 
• Artwork may have intentional artistic variations. 
• Product dimensions may have reasonable manufacturing tolerances. 

Such variations will not ordinarily be considered defects.

4. PRICING

All product prices displayed on the website are in Indian Rupees (INR) unless otherwise stated. Applicable taxes, shipping charges, customisation charges or other additional charges will be communicated at checkout or before order confirmation, as applicable. EVARA reserves the right to correct pricing or product information errors. If an order has been placed at an obviously incorrect price, EVARA may contact the customer before processing the order.

5. ORDERS

An order is considered confirmed only after:

1. the order has been accepted by EVARA; and 
2. the applicable payment has been successfully received. 

EVARA reserves the right to cancel an order in circumstances including product unavailability, pricing errors, suspected fraudulent activity, inability to fulfil an order, or other legitimate operational reasons. Where EVARA cancels an accepted and paid order, the applicable amount will be refunded through the original payment method or another mutually agreed method.

6. CUSTOM & CORPORATE ORDERS

Customised, bulk and corporate gifting orders may have separate:

• minimum order quantities; 
• pricing; 
• production timelines; 
• artwork requirements; 
• approval procedures; 
• payment terms; and 
• cancellation conditions. 

Such orders will be governed by the quotation or written order confirmation provided by EVARA. Once customised production has commenced, cancellation may not be possible.

7. INTELLECTUAL PROPERTY

All content appearing on the EVARA website, including:

• logos; 
• brand identity; 
• photographs; 
• product images; 
• artwork; 
• illustrations; 
• graphics; 
• text; 
• videos; 
• designs; 
• website layout; and 
• other creative material 

is owned by, licensed to, or used with permission by EVARA and/or the respective artists, creators or partners. No content may be copied, reproduced, modified, distributed, commercially exploited or used without prior written permission.

Artwork created by SHILPKAAR artists remains subject to the applicable copyright and licensing arrangements between the artist and EVARA.

8. USER CONDUCT

You agree not to:

• use the website for unlawful purposes; 
• attempt to gain unauthorised access to the website or its systems; 
• interfere with website security; 
• upload malicious code; 
• reproduce or commercially exploit website content without permission; 
• impersonate another person or organisation; or 
• use the website in a way that may harm EVARA, its artists, customers or partners. 

9. THIRD-PARTY SERVICES

EVARA may use third-party providers for payment processing, logistics, technology, communications, analytics, marketing and other services. Such third parties may have their own terms and privacy policies. EVARA will take reasonable steps to work with reputable service providers but cannot guarantee uninterrupted availability of third-party services.

10. LIMITATION OF LIABILITY

To the extent permitted by applicable law, EVARA will not be liable for indirect, incidental or consequential losses arising from the use of the website or products. Nothing in these Terms limits any consumer rights or legal protections that cannot lawfully be excluded.

11. CHANGES TO THESE TERMS

EVARA may update these Terms of Use from time to time. The updated version will be posted on this page with the revised effective date.

12. GOVERNING LAW

These Terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts having appropriate jurisdiction over EVARA's principal place of business, subject to applicable consumer protection laws.
